Key Steps in the H-1B Visa Lottery Process

  1. Registration: Employers must first register online with USCIS during the designated registration period. This is a critical step – no registration, no lottery participation!
  2. Lottery Selection: If more registrations are received than visas available (this happens all the time!), USCIS conducts a random lottery. Selected registrants are then eligible to file H-1B cap-subject petitions.
  3. Petition Filing: Once selected in the lottery, employers have a limited 90-day window to submit the H-1B petition on behalf of the beneficiary (the prospective employee).
  4. Adjudication: USCIS reviews and adjudicates the filed petitions. If approved, the beneficiary can start working under H-1B status from October 1st of that year.

For Employers: Your Checklist

  • Understand the Role: Ensure the job qualifies as a specialty occupation.
  • Employee Eligibility: Confirm that your prospective employee holds the necessary qualifications.
  • Wage Requirements: Be ready to pay at least the prevailing wage for the occupation and location.
  • Timely Registration and Petition Filing: Adhere strictly to USCIS timelines for registration and petition filing.

  • Educational Credentials: Have your degrees, certificates, and relevant qualifications in order.
  • Work Experience: Document your work experience, especially if it compensates for a lack of formal education in your field (3:1 – three years of work experience is equal to one year of academic requirement).
